These Terms of Service ("Terms") govern your use of the internet and related services provided by EnziMpya Fiber ("EnziMpya", "we", "us"). By subscribing to or using our services, you agree to these Terms.
1. Service & Installation
Service is subject to technical feasibility and coverage in your area. Professional installation is typically completed within 24–48 hours of a confirmed order in covered areas. Equipment such as the ONT and router may be provided under the applicable package; a router fee (currently KSh 1,500) applies as stated on the relevant plan.
2. Fees & Payment
- Subscription fees are billed in advance for the chosen billing cycle (monthly, quarterly or annually).
- Accepted payment methods include M-Pesa, bank transfer, mobile banking and cash.
- Service may be suspended where payment is not received by the due date, and reconnected once the account is settled.
3. Acceptable Use
You agree not to use the service for any unlawful purpose, to send spam, distribute malware, infringe intellectual-property rights, or engage in activity that disrupts our network or other customers. Business "No FUP" plans excepted, residential plans are subject to our Fair Usage Policy.
4. Equipment
Equipment supplied by EnziMpya remains configured for use on our network. You are responsible for reasonable care of the equipment on your premises. You may use your own compatible router; our technicians can assist with configuration.
5. Service Availability
We target 99.8% network uptime as described in our Service Level Agreement. While we strive for uninterrupted service, occasional maintenance or factors beyond our control may affect availability.
6. Upgrades, Downgrades & Relocation
You may upgrade at any time (effective immediately) or downgrade (effective from your next billing cycle). If you relocate within our coverage area we will endeavour to transfer your service; relocation outside coverage may require disconnection.
7. Termination
Either party may terminate the service with reasonable notice. We may suspend or terminate service for breach of these Terms, non-payment, or misuse of the network.
8. Liability
To the extent permitted by law, EnziMpya is not liable for indirect or consequential losses arising from service interruptions. Nothing in these Terms excludes liability that cannot be excluded under Kenyan law.
9. Governing Law
These Terms are governed by the laws of the Republic of Kenya, and any disputes shall be subject to the jurisdiction of the Kenyan courts.
